1. Buyers Inspection: Seller has done their best to disclose all information known about this vehicle for sale. Seller welcomes a buyers inspection. If you plan to take advantage of a buyers inspection, please make sure you inspect the vehicle prior to the purchase. Understand that the any inspection must take place on Seller's Property. Inspection fees, if any, are buyers responsibility. There will be NO INSPECTIONS after the close of the sale - it's just too late folks!
   
   Please do your due diligence if, for any reason, you are unsure about the quality of the vehicle in this sale. But also understand that this is a used vehicle, and things can break on your way home with your new baby. We will do what we can to minimize failures, but we make absolutely NO guarantees as to the appropriateness of this vehicle in your particular application. Vehicle longevity is completely dependent on how and where you drive, and how luck smiles on you - things over which we have absolutely no control, and take NO responsibility.
   
2. Representations and Warranties made by Seller: This vehicle is being sold "Where-is/As-is". Manufacturer's warranties may still apply, but probably do not, because of the vehicle's age. Maintenance insurance may be available from third party providers or dealers, check with your insurance company. No representations, guarantees or warranties, expressed or implied, are made by Seller, nor are any expressed or implied representations or warranties relied upon by Buyer during purchase. Your agreement to participate in this sale means you understand and agree to all of these terms and conditions.
   
3. Taxes and Registration fees: Out of state buyers are responsible for all state, county, city taxes and fees, as well as title service fees in the state in which the vehicle will be registered. We do NOT collect Sales Tax fees from residents of other states. We do not register the Title of any vehicle purchased by out of state buyers. Be prepared to show valid residency documentation (State issued picture Driver's License, etc). 
   
4. AZ Sales and Use taxes: All fees must be paid in full in order for vehicle to be titled and licensed in AZ. AZ Motor Vehicles Dept allows AZ Residents a grace period of 15 days in which to register, license and obtain insurance. We are required by law to alert the MVD within 24 hours (1 business day) that a vehicle has been sold, and to whom.
   
5. Title Information: All vehicles are sold with CLEAR titles, which means there are NO liens against the title, NO Salvage title restrictions, NO Rebuilt restrictions. We normally deliver the title to you after you have paid all sale totals & fees and arrive to pick up the vehicle you have purchased. 
   
6. PAYMENTS: A minimum $500 NON-REFUNDABLE DEPOSIT is required at the close of the sale. This NON-REFUNDABLE DEPOSIT is to be made through Paypal or in cash, and the balance of monies owed for the vehicle to be paid by Cash or Unconditional Wire Funds Transfer (directly to our bank from your bank).
   
   We DO NOT accept Cashier's Checks, M.O.'s, personal checks, or any other instrument except Paypal or Cash for NON-REFUNDABLE DEPOSIT and then, only Unconditional Wire Funds Transfer or Cash for the balance owed. NON-REFUNDABLE DEPOSIT means that you will lose your $500 deposit if you cannot generate the proper Unconditional Wire Funds Transfer or Cash with in 3 Business days. 
   
7. This is real simple #1: IF YOU DO NOT PAY THE MINIMUM NON-REFUNDABLE DEPOSIT AFTER YOU AGREE TO PURCHASE, OUR PURCHASE AGREEMENT IS NULL AND VOID AND WE WILL PUT THE VEHICLE BACK ON THE MARKET.
   
8. This is real simple #2: IF YOU PAY THE MINIMUM NON-REFUNDABLE DEPOSIT AND CANNOT PAY THE BALANCE OF THE MONIES OWED WITHIN THREE BUSINESS DAYS OF THE PURCHASE, THEN YOU LOSE YOUR DEPOSIT, OUR PURCHASE AGREEMENT IS NULL AND VOID, AND WE WILL PUT THE VEHICLE BACK ON THE MARKET.
   
   If you think that you are ready to purchase but you are not prepared to pay the minimum deposit, or if you can afford the deposit, but cannot afford to pay the balance owed by wire funds transfer or cash within three days, then  PLEASE DON'T AGREE TO PURCHASE IN THE FIRST PLACE - Save yourself (and us) the aggravation and save your credit rating in the community.
   
9. Shipping & Delivery:
   1. All shipping charges, if any, are buyer's responsibility. As a guide, you can expect to pay somewhere around $700 for a coast-to-coast transport, more or less. Google for help in locating a shipping carrier. The Seller will not be responsible in any way for claims arising from shipping damage!
      
   2. Licensed Carriers are generally insured for $3,000,000.00. We assume no responsibility for damages incurred after the vehicle leaves our lot. Make absolutely sure that your Transport Carrier is responsible for your car from the end of our driveway to the end of yours. 
      
   3. Shipping information (if any) is provided by Seller as a courtesy. We are not affiliated with any carrier. Any claims or other communication regarding shipment of vehicles will be between you and the shipper, not with Seller. Seller does not prep (wrap, etc) the vehicle in any way for transit. Prepping for transit is the Buyer's sole responsibility. 
      
   4. Seller does NOT pack ANY documents with the vehicle to be shipped.
      
   5. The amount of time it takes for delivery is dependent on the carrier, but is generally 7-14 days from the date the vehicle is picked up from our facility until it is delivered to your destination. Verify with the shipper for an Estimate Time of Arrival to be sure.
      
10. Finalizing your Purchase:
    1. Buyer will contact the Seller in person or by email to Sales@ModernClassicMustangs.com and agree to purchase.
       
    2. Buyer MUST make the required minimum Non-Refundable $500 Deposit through Paypal or Cash at the time of the sale.
       
       If we cannot confirm your intention to buy (no deposit at time of sale, or no final payment within 3 business days of purchase), we reserve the right to resell this vehicle to any other qualified buyer. (Refer to the above for a description of the bad things that can happen if buyer doesn't pay the deposit or payment balance.)
       
    3. In order to secure purchase of vehicle, within 72 hours of the sale closing, Buyer must remit balance of funds by Cash, or by Unconditional Bank Wire Funds Transfer directly to the bank account of the Seller. Seller will provide to the Buyer, the Seller's Bank Account Number and Routing Number after Deposit has been paid by the Buyer.
       
    4. At time of initiating deposit through Paypal, Out of State Buyers MUST fax a copy of their State issued valid picture Driver License to us at 928-493-3687. Alternatively, scanned documents may be sent directly to the Seller by email to: Docs@ModernClassicMustangs.com. Furthermore, before said vehicle is released for shipment to Buyer, all other Sales-related and Title-related documents, if any, must be completed, signed and returned to the Seller's satisfaction.
       
    5. If the vehicle is to shipped by Commercial Carrier: After all outstanding balances have been paid by the Buyer to the satisfaction of the Seller, the Title will be sent to the Buyer by Priority Mail (Adult Signature Required) along with an acknowledgement that the Buyer understands that Sale is As-is/Where-is, without Warranty, expressed or implied. The "Confirmation of Receipt of Title and Acknowledgement" document that accompanies the Title, will need to be signed, notarized and returned to Seller in the Prepaid Return Envelope, BEFORE vehicle will be released to the Commercial Carrier. There will be no exceptions. All paperwork MUST be in the hands of the Seller before car will be released.
       
    6. If the vehicle is being picked up, the Title will be handed over to the Buyer along with the available Keys at the time of pickup (and probably a full tank of gas) upon full Cash payment of all balances owed to the Seller's satisfaction. Seller will provide, at no charge, an ADOT 3-day temporary moving permit for moving the vehicle legally on the streets in AZ. Buyer will sign an acknowledgement that (s)he understands that the Sale is executed As-is/Where-is, without Warranty of any kind, expressed or implied, and that the Buyer has taken custody of the Signed Title and Keys from the Seller, thereby concluding the purchase contract between Buyer and Seller.
       
11. NOTICE: (THIS MAY BE A DEAL-BREAKER FOR OUR OUT OF AREA BUYERS): Understand that while we make every effort to ensure that the vehicles that we sell are completely safe, please note that the cars we sell are NOT warranted to pass State or Local Vehicle Emissions or Equipment Inspections. Vehicle Emissions and Equipment Inspections vary radically throughout the US, and trying to adhere to all of them is impossible. Emissions and Equipment Inspections are not required in our sales area on any car that we sell. If you are registering your new vehicle in an area with Emissions or Equipment Inspections, understand that you are entirely responsible for any repairs necessary to pass those inspections.

We've been doing this a long time, and have learned to recognize the bottom feeders who only want to get something for nothing. AZ law has changed to better protect the Sellers in vehicle transactions, so it is getting harder and harder for scammers to mess with sales. Understand that we are a big enough corporation to prosecute scammers. If you are one, save yourself the grief and move along - there is nothing here to for you to see.

Therefore, if you are asked by one of our salespeople for some information, don't fret, we are just trying to ascertain your (and our) comfort level with this purchase. We will not tolerate bottom feeders trying to complicate your life during this transaction.
